1. Acceptance of Terms
By accessing and using What's Up Marshall County ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement.
2. Use License
Permission is granted to temporarily access the materials on the Platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.
Under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display
- Attempt to reverse engineer any software contained on the Platform
- Remove any copyright or other proprietary notations from the materials
3. User Accounts
When you create an account with us, you guarantee that:
- The information you provide is accurate, complete, and current
- You are legally capable of entering into binding contracts
- You will maintain the security of your password
- You will notify us immediately of any unauthorized access to your account
4. Business Accounts
Business accounts require verification and approval before activation. We reserve the right to:
- Reject any business registration application
- Suspend or terminate accounts that violate these terms
- Require additional documentation for verification
- Modify or remove content that violates our guidelines
5. Event Listings
Businesses posting events agree to:
- Provide accurate and truthful information about events
- Maintain current and updated event information
- Hold proper licenses and permissions for events
- Comply with all applicable laws and regulations
We reserve the right to remove any event listing that violates these terms or is deemed inappropriate.
6. Sponsorship Services
Sponsorship agreements are subject to separate terms and conditions. Sponsorship benefits include but are not limited to:
- Featured placement in carousel
- Enhanced visibility in search results
- Priority support
Sponsorship fees are non-refundable except as required by law.
7. Prohibited Conduct
You may not use the Platform to:
- Post false or misleading information
- Impersonate any person or entity
- Engage in any unlawful conduct
- Transmit any viruses, malware, or harmful code
- Scrape or harvest data without permission
- Interfere with the proper functioning of the Platform
8. Intellectual Property
The Platform and its original content, features, and functionality are owned by What's Up Marshall County and are protected by international copyright, trademark, and other intellectual property laws.
Users retain ownership of content they submit but grant us a license to use, display, and distribute such content on the Platform.
9. Disclaimer
The materials on the Platform are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
10. Limitations
In no event shall What's Up Marshall County or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Platform.
11. Third-Party Links
The Platform may contain links to third-party websites. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.
12. Modifications
We may revise these terms of service at any time without notice. By continuing to use the Platform after revisions become effective, you agree to be bound by the revised terms.
13. Governing Law
These terms shall be governed and construed in accordance with the laws of the state where Marshall County is located, without regard to its conflict of law provisions.
